1. Acceptance of Terms

By downloading, accessing, or using the BBSYNR mobile app or website (“Service”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree, you may not use the Service.These Terms form a legally binding agreement between you (“User,” “you”) and BBSYNR (“we,” “us,” or “our”).

2. Description of Service

BBSYNR is a mobile signing tool that allows real estate professionals and their clients to digitally complete and sign Buyer Broker Agreements and related forms using a touch-enabled device.

The Service is intended to streamline the signing process but does not replace legal advice or brokerage compliance requirements. Users are solely responsible for ensuring all signed documents comply with applicable state and federal real estate laws.

3. Eligibility

You must be at least 18 years old and legally authorized to enter into binding contracts to use this Service. By using BBSYNR, you represent and warrant that you meet this requirement.

4. Use of the Service

You agree to use BBSYNR only for lawful purposes and in accordance with these Terms.

You agree not to:

Upload or use false, misleading, or unauthorized information.
Violate any applicable laws or regulations, including real estate licensing rules.
Use the app to forge signatures or misrepresent identity.
Reverse engineer, modify, or attempt to access any restricted parts of the platform.

All partners are contractually required to maintain strong privacy protections.

5. Data Security

We use industry-standard security practices including:

Encryption of documents and signatures at rest and in transit
Access controls and authentication protections

Although no system can be guaranteed 100% secure, we continuously work to better safeguard your data.

6. Signatures and Legal Effect

Electronic signatures created through BBSYNR may be legally binding under the U.S. E-SIGN Act and Uniform Electronic Transactions Act (UETA), provided all parties consent to electronic signing.

BBSYNR provides a platform for document execution but does not verify user identity, intent, or legal capacity.

All users assume full responsibility for verifying the validity and enforceability of their signed documents.

Requests may be subject to legal brokerage recordkeeping requirements.

7. Account and Data Responsibility

Users are responsible for any data, documents, or information uploaded or created within the Service. BBSYNR is not responsible for:

Errors in user-entered data,
Loss of data due to device malfunction, or
Misuse of signed forms by third parties.

8. Fees and Donations

The Service is currently free to use. Users may choose to make voluntary in-app donations to support future development.BBSYNR reserves the right to introduce premium features or subscription plans in the future.

Deletion requests will be honored when permitted by law.

12. Limitation of Liability

To the maximum extent permitted by law, BBSYNR and its affiliates are not liable for any indirect, incidental, or consequential damages arising from:

The use or inability to use the Service,
Errors or inaccuracies in signed documents,
Unauthorized access to data, or
Loss of profits, data, or goodwill.

Your sole remedy for dissatisfaction with the Service is to stop using it.

13. Indemnification

You agree to indemnify and hold harmless BBSYNR, its owners, employees, and affiliates from any claims, damages, liabilities, and expenses (including attorney fees) arising from your use of the Service or violation of these Terms.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or engaged in unlawful or abusive behavior.

15. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to its conflict of law provisions.

Any disputes shall be resolved in the courts located in Maricopa County, Arizona.

16. Changes to Terms

We may modify these Terms at any time. The updated version will be posted with a new effective date. Continued use of the Service constitutes acceptance of any revised terms.
